Possibility of withdrawal from the contract and complaints
If the organizer cancels a tourist event for reasons beyond the control of the Customer (in accordance with the provisions of Article 46 of the Act on tourist services), the Customer has the right, at his choice:
a) participate in a substitute event of the same or a higher standard, unless he agrees to a lower standard event for a refund of the difference in price,
b) demand reimbursement of incurred fees and payments.
In this case, the customer may seek compensation for non-performance of the contract, unless the cancellation of the package occurs due to:
a) fewer participants than the minimum number, and the organizer will notify the client in writing on the agreed date,
b) unavoidable and extraordinary circumstances.
The Customer may withdraw from the contract at any time. Withdrawal from the contract requires a written form. In this case, the Customer is obliged to return all travel documents issued by the organizer and is entitled to a refund of the amount paid after deducting the cancellation cost, determined individually in each case. The cost of resignation includes the costs incurred by the organizer in connection with the conclusion of the contract by the Customer and subsequent withdrawal from it and corresponds to the price of the tourist event reduced by the costs saved or proceeds from the alternative use of the tourist services concerned.
As the resignation from participation in the event on the part of the client, which entails the obligation for the Client to return to the Organizer the costs incurred by the Organizer in connection with the resignation shall also be understood as:
a) refusal to issue a passport, visa, no documents entitling to cross the border,
b) preventing border crossing by border services,
c) not arriving for the collection (when leaving by collective transport),
d) not reporting at the place of performance of the services provided by the pilot or other representative of the Organizer indicated in the program and / or voucher,
e) resignation due to illness and other random cases.
If during the event the Customer finds faulty performance of the contract, he should immediately notify the service contractor and the Organizer, and cooperate to avoid any further damage.
The Customer may submit a written complaint to the Organizer within 30 days of the end of the event.
Complaints shall be considered no later than:
a) in the case of a complaint during the event - within 30 days of its completion,
b) in the case of a complaint after the event - within 30 days of its submission.
If the complaint is submitted after the deadline, the Organizer may consider it ineffective.
In the event of refusal to accept a complaint, the Tourism Organizer shall justify in writing the reasons for the refusal.
The organizer informs that if the complaint is not accepted, the Customer may use the methods of out-of-court resolution of consumer disputes, referred to in the Act of 23 September 2016 on the out-of-court resolution of consumer disputes (Journal of Laws item 1823) and the online platform dispute settlement system in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the online consumer dispute resolution system and amendments to Regulation (EC) No 2006/2004 and Directive 2009/22 / EC (Dz. EU L 165 of 18/06/2013).
